Just out of curiosity, if I were to move to your emissions regulated states, would I be able to keep my eagle registered in MN (no longer regulated) and still be able to drive the car? I would love to move to a mountainous area in the future. Am I gonna be doing myself a no no by removing all the emissions related equipment? I love a clean engine compartment for ease of maintenance.
I believe you'd need a residence in the state in order to continue registering there. I have a friend that's lived in Chicago for many years, but for some reason he's kept his Missouri plates. I guess he still has his drivers license listed through his parents house or something?

And regardless of where you live, its against federal law to remove emissions equipment from your vehicle. ;)
In Colorado, its actually only a small part of the state where emissions tests are required, and where they will do a visual inspection to look to see that all of your emissions equipment is installed. This area is from about Ft Collins to Castle Rock, along the front range. If you actually live in the mountains, no test is required. People have been known to register their vehicles in non-emissions areas, using a friend's address or a PO Box, to avoid the emissions testing requirement.
If you do happen to remove your emissions components, I would save them in case you move to an emissions testing area, or you sell the car to somebody that lives in one of those areas.
I have one that is getting a full jeep drivetrain transplant and one that will get a 4.0 head on a mild stroker motor so visual will not pass. Both cars will probably run cleaner than stock in the end.

If you are transplanting a newer engine, as long as you have all the emissions equipment that came with that engine, you will be good. I think there is an extra step involved to get your new engine approved, but you should be okay with that one. The partial upgrade may cause you problems, although if you're going with fuel injection on the mild stroker engine, and have the O2 sensor and any other emissions equipment for a 4.0 engine, that should work too.
That was my concern. I'd like to have the mpfi driveablity as well as the cleaner engine compartment. In the loooong run a turbo might happen but that's all just a pipe dream at this point. Has anyone had any issues getting passed with the HEI?
I can't imagine you'd have any problems with the HEI, with either the do-it-yourself version posted on this website, or going with the all in one distributor. They aren't trained to look that far in depth. I had done the DIY HEI on my Kammback before my test, and it didn't raise any eyebrows. My friend had an SX/4 and said half of the emission stuff was missing and he still passed the visual inspection. They look for the cat on all vehicles, I'm guessing on our Eagles the only other thing they might notice as missing was a smog pump or EGR. But again, if you're doing a complete swap and have the emissions stuff for the new engine, which on a 4.0 isn't much, you'll be able to pass.
